Effect Of Growth Factors Fcs On Cell Proliferation Biology Essay Introduction: The technique in which cells normally of one type, removed from animal tissue are grown in presence of supplements and growth factors under controlled conditions is called Cell Culturing. Different cells require different conditions of temperature and gas for their appropriate growth in a cell incubator moreover growth media plays a crucial role in cell culturing, which can vary in glucose concentration, pH, growth factors like fetal calf serum (FCS). The effect of one of the above mentioned variables, we are going to study in this experiment is growth factors. Growth factors as the name suggests enhancers the growth which supplements the media are obtained from animal blood such as calf serum. Cell proliferation is studied by various methods, mainly used methods involve measuring the colour intensity taken up by DNA of cell during cell proliferation in presence of staining dyes e.g. crystal violet and MTT (3-(4,5-dimethyl thiazol-2-yl)-2,5-diphenyl tetrazolium bromide). The aim of this experiment is to study cell proliferation by using crystal violet and MTT methods while using mouse Y1 adrenocortical cells under the effect of growth factor FCS. Mouse Y1 adrenocortical cell are grown in Dulbeccos modification of Eagles medium as monolayer cultures. Crystal Violet: It is biological stain used in cell proliferation method which stains DNA of the cells after permeabilisation with methanol. The positive ammonium ions of crystal violet stain DNA of cells in blue colour. The colour intensity produced is directly proportional to number of cells, which is determined in stained cells by colorimeter. Staining with crystal violet and MTT are based on principal of absorbance. MTT: The MTT assay is a standard colorimetric assay in which activity of reductase enzymes are measured which convert MTT to blue insoluble formazan. The metabolic activity of viable cells is used as basic parameter in MTT assay. The tetrazolium salt, MTT is now widely used in quantitative measurement of cell proliferation. This method depends upon uptake of MTT by viable cells, which is a water soluble tetrazolium salt producing a yellowish solution. MTT is cleaved to insoluble blue formazan in the mitochondria of living cells by succinic dehydrogenases in the mitochondrial respiratory chain. Material Used: Mouse Y1 adrenocortical cells, Dulbeccos medication of Eagles medium (DMEM) containing 10% Fetal calf serum, 2mM glutamine, 100u/ml penicillin and 100mg/ml streptomycin, crystal violet stain (0.1% solution in 200mM boric acid), MTT (5mg/ml MTT solution in PBS), PBS methanol, 10% glacial acetic acid, distilled water, acid-isopropanol. Apparatus used: Laminar flow cabinet sterilized two 96 well plates, multi well pipettes, pasture pipettes, sterilized T-flasks, sterilised empty reservoirs, gas incubator, fume cupboard, spectrophotometer etc. Method: Cells of mouse Y1 adrenocortical were separated from their substratum with tris in EDTA as they grow in monolayer cultures. Then added same volume of medium and centrifuged after that number of cells were counted on haemocytometer and diluted to concentration of 1.25 à ¢Ã¢â‚¬ ¦Ã‚ © 105 cells/ml and made it up to 30 ml. Then cells were passaged into centre 60 wells of 96 well plate in duplicate with concentration of 0.25 à ¢Ã¢â‚¬ ¦Ã‚ © 10à ¢Ã‚ Ã‚ µ cells/ 200ÃŽÂ ¼l in each well while outside wells of 96 well plate were filled with same amount of phosphate buffered saline (PBS) and allowed the cells to incubate overnight at 37  °C temperature in humidified gas incubator. After that cells were washed with PBS three times and different wells of each plate were treated with different concentrations of FCS which is shown in table 1. Hence 12 wells of each plate were treated with 0, 1, 5, 10 and 20% v/v concentration of FCS and both plates were incubated for 72 hours. One plate was used for crystal violet staining method and other for MTT assay. After that were fixed with 200ÃŽÂ ¼l of methanol for 15 minutes in fume cupboard. Then methanol were removed and cells were allowed to dry in fume cupboard for few minutes. Then cells were treated for 20 minutes with crystal violet stain 200ÃŽÂ ¼l/well. Later cells were washed three times with distilled water and stained cell layer was allowed to solubilised in the 50ÃŽÂ ¼l of 10% glacial acetic acid and plates were incubated for 30 minutes in gas incubator. After that absorbance of each well was read by plate reader spectrophotometer set at 540nm. MTT Method: To perform MTT assay, each of centre 60 wells of 96 well plate was treated with 20ÃŽÂ ¼l of MTT solution and plate was incubated for 4 hours at 37o C temperature in gas incubator. After 4 hours, the medium was removed from each well and 100ÃŽÂ ¼l of acid-isopropand was added to dissolve blue formazan crystal in the cell layer. Then plate was incubated for 30 minutes at room temperature. When blue formazan crystal were solubilised, absorbance of each well was measured at 570nm using the plate reader. Calculations: Cells in five squares of Haemocytometer = 24 Volume of each square is =4ÃÆ'-10-3ÃŽÂ ¼l The no. of cells in five squares multiplied with 5ÃÆ'-104 gives no. of cells in 1ml. Hence no. of cell in 1ml = 1.2ÃÆ'-106 cells/ml Required cell suspension = 1.25ÃÆ'-105 cells/ml Dilution Factor = Concentration Required/Concentration got Dilution Factor = 0.104 Therefore, in order to make 30 ml of cell suspension 3.125 ml of cell suspension was mixed with 26.875 ml of medium. Similarly 30 ml of cell suspension was prepared having 1.25ÃÆ'-105 cells/ml. Discussion: Crystal Violet Staining method and MTT Assay is based on principle of absorbance, more is colour intensity, more will be the absorbance value. The result of Crystal violet staining method clearly indicated that absorbance value was directly proportional to cell proliferation as it was increasing with concentration of FCS. FCS stimulated Cell Proliferation Result in more cells and DNA Methanol increased cell membrane permeability Result in more stained DNA More Colour intensity Hence More Absorbance Value Similar results were seen in MTT Assay but in this assay only viable cells were stained while in crystal violet method both viable and non viable cells were stained. So Crystal Violet method of staining is not specific staining technique because in this absorbance is not direct index of cell viability. The drawback of MTT Assay is that some reducing agent may reduce MTT also which could show slight increase in absorbance, moreover this method depends on some variable like pH, presence of D-glucose and pyridine nucleotides which can affect the specificity of Assay. In spite of above said limitations these methods are mostly followed because they are safe, simple, cheap and reproducible. Differentiation of K562 cells to megakaryocytes/platelets To study cell differentiation of K652 cells chronic myelogenous leukaemia, K652 cell line, indicates an early differentiation stage of granulocyte lineage. K652 cells are non-adherent, circular shaped with small microvilli. In the presence of tumour promoters like phorbol myristate acetate (PMA) these type of cell are differentiated to megakaryocytes. The induction of megakaryocytic differentiation of K652 cells is known to be initiated by two signalling pathways which are the nuclear factor kappa B(NF-ÃŽÂ ºB) -depends pathways and other is extracellular signal regulated kinase (ERK)/mitogen activated kinase (MAPK) dependent pathways. Human chromic myelogenous leukemic cells, K652 cells have Philadelphia chromosome. Tumour promoter, PMA which is a potent mitogen for human peripheral blood lymphocyte also act as a protein kinase C (PKC) activator which differentiate K652 cells to megakaryocytes. The various changes that occurs during differentiation of K652 cells are: Changes in cell morphology Cell growth arrest Adhesive properties of cell change Expression of markers associatated with megakaryocytes Endomitosis NADPH oxidase complex which is known as a primary source of ROS (Radio active oxygen species), is initiated by PMA. PMA stimulates NADPH ROS (Signalling Molecule) Induction of gene expression is directly related with ROS. The Expression of CD61, a platelet cell marker helps in identifying differentiated cells. The expression of CD61 can be seen on platelets, osteoclasts, macrophages and on some tumour cells, involved in tumour metastasis and in adenovirus infections. Results and Discussion: It was observed that PMA treated slide was stained pink while cells devoid of PMA were stained blue as shown in Pic. 1 2. In PMA treated slide the K562 cells were clearly differentiated to megakaryocytes which suggested that tumour promoter, PMA induced differentiation in K562 cells by signal transduction and expressed by CD61 as shown in picture below. The cells were stained pink because fast red dye get attached to APAAP so this is how CD61 was expressed in cell treated with PMA. Moreover cells treated with PMA were larger, irregular, in shape and fewer in number as compare to untreated cells. On the contrary, Cells devoid of PMA were much smaller in size than treated cells. George Orwells Nineteen Eighty-Four 1984 Essay -- essays research pa

Nineteen Eighty-Four is a compelling novel, written in the period just after W.W.II. It details the life of one man, Winston Smith, and his struggles with an undoubtedly fascist government. The book is set approximately in the year 1984, in which Winston's society is ruled by a governing force known as "The Party". At the head of this government is a fictional figure known as Big Brother, to whom all citizens must love and respect. In this society, privacy and freedom do not exist. People are constantly monitored by telescreens, and subjected to a constant barrage of propaganda. Any devious thought or action is dealt with by cruel and deadly punishment. Winston is a worker in one of the government agencies. His job: to rewrite the past so that The Party, specifically Big Brother, appears to be omnipotent. From as long as he can remember, he has despised The Party and what it stood for, although he doesn't reveal his true feelings to anyone around him. When Winston begins a torrid love affair with one of the young women in his agency named Julia, he finds someone else who shares in his beliefs. The two have several meetings throughout the book, in which they discuss their hatred for the government. They join a secret alliance called The Brotherhood, who's specific purpose is the end of The Party. Through the literature of The Brotherhood, they learn about the inner workings of The Party and how it accomplishes its stronghold on the people. The world as Winston knows it comes crashing down when he and Julia are arrested by the thought police, a faction of the government which deals with those who do not agree and abide by the ways of The Party. They are taken to a prison unlike any other. Winston is constantly tortured and beaten, until he confesses to crimes which he didn't commit or never even happened. If the party just killed Winston right away, they might run the risk of making a martyr out of him. Instead they re-educate him with the morals of The Party, using such techniques as pain, starvation, and using Winston's greatest fear against him. Once re- educated, he is introduced back into society. But he is not the same person, just a hollow shell. Winston had once said in the novel that if he could die hating Big Brother, then he would have won. But when Winston is finally killed, the only thing he can think is that he love... ...ten path in search of a greater truth. The novel also caused myself to reflect upon how important it was that such tyrannical dictators such as Hitler have been stopped, sometimes with great costs, from making life unbearable. Reading this novel gave me a great sense of hope for human kind, as we have been able to keep totalitarian movements under control. Maybe sometimes people can get carried away with a lust for power, but it will always come back to living in a society that is tolerable to everyone. It is safe to say that a Utopian society will never exist, but we must make an effort to get as close as we can. Many disputes which occur today are because of petty differences between people. Although there are some flaws in human nature, we have always been able to keep from digging a grave too deep to climb out of. It is scary to think how close the world could have come to having a society like the one in Nineteen Eighty Four, and know that we as humans have to gain a better understanding of one another. I enjoyed reading this book because not only did it give the reader something exciting to read, but it also was able to put an interesting perspective on life itself.

Behaviorism the beginnings

Behaviorism is one of the most influential schools of psychology, especially American psychology. The development of behaviorism was spurned as a reaction to structuralism and functionalism. Behaviorism was posited as a revolution in the methodology of the science of psychology (Hothersall, 1995), while structuralism and functionalism have argued that the rightful object of study of psychology is the mind and consciousness and have developed methods that congruently were subjective and enabled the psychologists of that time to study the mind and consciousness.Although behaviorism has become established as a major force in psychology, in its earlier days it was not popular and embraced by many psychologists. However as behaviorism evolved and developed into a theoretically based and objective science many have found its assumptions practical and scientific. Western psychology’s history is short and colorful compared to other sciences, it started with structuralism from Germany with Wundt at the helm (Murphy, 1930). When psychology arrived in America it obviously followed structuralism, and since it was too philosophical for the American scholars.James developed his own paradigm and called it functionalism, which in essence focused on the function of consciousness in explaining behavior than in studying the structure of the mind. Functionalism held greater influence in American psychology but together with structuralism it still espoused that psychology is the study of the mind and consciousness. The zeitgeist of that period was that the focus of psychology is the understanding of the human mind and internal experiences (Hothersall, 1995).This inspired psychologists to devise methods of studying perception and consciousness in the attempt to discover the workings of the human mind. Research at that time was centered on identifying and describing physiological experiences and how it affected human behavior. Psychologists were comfortable with the notion tha t psychology is the study of the mind and most of them wrote about the self, attention, consciousness, perception and even mental processes that were believed to be the cause of human behavior.At this point, methods used to study the human mind were subjective and did not lend itself to replication and reliability which in turn questioned the veracity of psychological researches. Although functionalism stressed that the mind and consciousness were responsible for human actions, they viewed behavior as a product of mental processes and ignored its importance in the study of psychology. Functionalism however stressed the application of psychological knowledge to practical issues such as learning, education and organizational development.The pragmaticism of functionalism led it to the discovery that human behavior is as much important to study since it is directly related to the human mind. Functionalism also identified the shortcomings of structuralism and its methods and since it was heavily influenced by Darwin, functionalism also welcomed the idea of studying animals in laboratories to test psychological assumptions. While this new developments were gaining support, a new school of psychology emerged from the work and writings of Ivan Pavlov (Hothersall, 1995).Pavlov was able to demonstrate that a dog can be trained to salivate with just the sound of a bell intrigued some psychologists and became one of the most popular teachings in psychology; Pavlov called this process classical conditioning. In America, John B. Watson was impressed with the experiments of Pavlov that he embraced the idea that behavior is the mot important aspect of man that should be studied by psychology (Watson, 1913). John B. Watson was an influential person and he is conventionally credited to be the father of behaviorism as he strongly and eloquently articulated the new psychology of that time.Central to Watson’s argument was that he accepted that animal behavior is quite simil ar to human behavior and that they are legitimate subjects in the experimental study of behavior. Earlier, it was mentioned that behaviorism was revolutionary in the sense that it developed a methodology of study of psychology and that it held few theoretical explanations to human behavior. Watson (1913) posited that any behavior is a response to a stimuli and the relationship between the stimulus and the response should be the subject matter of psychology.Watson also erased the mental processes that the structuralism and functionalism was focused on, arguing that studying mental processes are futile and subjective and did not uphold the scientific and experimental tradition of the discipline. Watson became the editor of the Psychological Review, one of the earliest scientific journals in psychology and used his position in the paper to put forth his ideas and conceptualizations of psychology as the behaviorist would see it (Watson & Evans, 1990).Watson was a radical behaviorist, he always referred to himself as â€Å"the behaviorist† and it implied that he renounced all mental processes as devoid of any psychological insight. He was famous for his experiments with Little Albert, wherein he conditioned fear of white and flurry objects in a small child. He demonstrated that fear can be conditioned and that it is manifested in different objects that fit the original object used as a stimulus (Watson, 1928).Watson believed that every action is a product of conditioning and that genetics or cultural orientations does not have anything to do with it. When asked to explain thinking, he said that thinking was not a mental process per se; instead it is an act of speaking in symbolic form (Watson, 1913). Introduction Qatar has a well-developed and structured legal system. The origin of the Qatar legal system is found in both ancient and traditional sources. It is based on Islamic law and jurisprudence but has adopted many of the principles of the Napoleonic Civil Code (French Civil Code). In addition, Egyptian philosophy of law and procedure (Egyptian Civil Code) had a great influence on the legal and judicial system of Qatar. The State of Qatar is a traditional country ruled by Al-Thani family and the state leadership being inherited by Al-Thani family since mid-19th century Qatar’s judicial history was influenced by a series of events beginning with the Ottoman occupation of the region in the 19th century. As stated in Background to legal system in Qatar by Qatar Law website â€Å"The Ottoman rulers established a system of justice based on teachings of the Hanafi school of Islamic Law. As the Ottoman Empire started to lose its grip on its rule in Qatar and elsewhere in the Arabian Gulf, Qatar underwent a gradual shift towards the Hanbali school of Islamic Law under the influence of the then emerging regional power, Saudi Arabia† (Partners, 2014). Qatar became a protectorate of Britain after the 1916 treaty and British legal system was established formally after the treaty. The civil courts established by British enforced English laws albeit local courts continued to administer a legal system based on Sharia law (Islamic law) which was the legal system in pre British era. This practice created a dual court system that existed until recent time in Qatar. Modern Qatar legislative process began in 1961, when Law No. 1 for the year 1961 was issued. Subsequently, several modern legislations covering the administrative, economic and social activities were enacted. Qatar passed the new Judicial Law No. 10 for the year 2003 in October 2003 which revolutionized and unified the judicial system in Qatar. This law became effective in October 2004. Qatar enacted a new Civil Law in 2004, providing applicability in respect of limitation of time and territorial jurisdiction. Other important definitions such as of natural and juridical persons principles and legal capacity to sue and be sued were incorporated in to the new Civil Law. Contractual relationships in construction sector were codified as Law No. (22) of 2004 with the passing of Qatar Civil Law. Law No. (22) of 2004 Promulgating the Civil Code was issued by H/H Hamad Bin Khalifa Al Thani, Emir of Qatar exercising the executive authority vested under the Constitution. As stated in Qatar Law website â€Å"Qatar Civil Code provides guidelines for the establishment of contractual relations and obligations arising therefrom. It specifies basic elements of a contract such as consent, subject matter, and purpose of contracting. It also deals with annulment, construction and binding nature, effect, and cancellation of contracts† (Partners, 2014). The UAE federation comprising seven Emirates namely; Abu Dhabi, Dubai, Sharjah, Ras Al Khaimah, Umm Al Quwain, Ajman and Fujairah was established on 02nd of December 1971. The Constitution declares the Sharia is the principal source for law in the UAE and a civil law jurisdiction heavily influenced by the Egyptian law system which was heavily influenced by French and Roman law. Commercial transactions are governed by UAE Federal Commercial Transactions Law ‘Commercial Code’ (No. 18 of 1993). Civil transactions are governed by UAE Law of Civil Transactions ‘Civil Code’ (No. 5 of 1985 No. 1 of 1987) (Whelan, 2011). In the absence of any specific provisions in Civil Code , the Islamic Sharia law will be applied. In matters of procedure, the UAE courts follow the Federal Civil Procedure Law ‘Civil Procedure Code’ (No. 11 of 1992 as amended). Articles 872 to 896 of the UAE Civil Law 1987 (the Civil Law) relating to construction works, as well as general maxims and principles set out in the same law, form the basis of the legal framework relating to construction. Also, UAE Commercial Transactions Law provisions would apply to the degree that the parties to a construction claim could be defined as traders conducting commercial business as per Articles 6 and 11. The general principle of freedom and sanctity of contract is recognized under the Qatar Civil Code and a contract is treated as the law of the contracting parties. Natural and legal persons are free to agree on whatever they desire, provided that their agreement does not conflict with law, public order and morality. Verbal contracts and contracts as a result of conduct of the parties are mostly recognized and are enforceable in court subjected to establishing / proving the contractual-relationship. The Civil Law also deals with interpretation of contracts, contractual responsibilities, liability for personal acts, and responsibility for acts of third parties, ownership responsibilities, surety, unjust enrichment, types of sale, lease, insurance, and rights attached to property, land law, mortgage, wills, legacy, privileges, and gains. It also stipulates performance, compensation and compulsory execution, assignment of rights, innovation and impossibility of performance and statutes of limitation. Contractors are often faced with employer- driven Omission, Suspension Termination of the Construction Contracts due to financial constraints and other difficulties encountered by Clients and Contractors in Qatar Middle East in general. Medium to large scale public works projects procured by Public Works Authority of Qatar (Ashghal) use General Conditions of Qatar (its own spoke form) published by Contracts Engineering Business Affairs (CEBA) which were updated and reissued on July 2007 prepared by either in-house lawyers or external law firms. The Qatar General Conditions of Qatar is a close resemblance of International Federation of Consulting Engineers (FIDIC) Yellow, Silver or Red Book contracts. The other major projects procured by state affiliated organizations such as Qatar Foundation, Qatar Gas, RasGas, Qatar Water Electricity board (Kharamaa), New Doha Aiprt Steering Committee use their own bespoke and â€Å"project specific† forms. Where a project is awarded on a lump sum basis, the 2007 General Conditions of Contract favoured by employers in Qatar places much of the risk for losses on the contractor, except where losses are adequately covered under the amended provisions to the Contract. A reasonably fair assessment of the General Conditions of Contract by many contractors in Qatar is that it heavily favours the employer. While this may be the case, a contractor may also be entitled to claim equitable relief in accordance with the Qatar Civil Law No. 22 of 2004. In the above scenario, it is imperative to analyze the rights and entitlements of Clients Contractors in circumstances arising from Omission, Suspension Termination of the Construction Contracts under FIDIC 1987 revision 4 FIDIC 1999 which are base documents for most of the Bespoke Conditions of Contracts in Qatar and its enforcement under the Civil Law of Qatar U.A.E. 2. Aim Analyze the legal aspects of Omission, Suspension Termination of the Construction Contracts under the Qatar U.A.E Civil Law. 3. Objectives There are four objectives of this study: To identify the limit of a Contractors’ exposure to the Employer in respect of Omission, Suspension Termination of the Construction Contracts. To identify the limit of Employer’s exposure to the Contractor. Analyze the entitlements between FIDIC suit of Contracts and Qatar U.A.E. Civil Code To determine reasonable solutions and precautions. 4. Research methodology The following Literature was reviewed during the initially to ascertain the feasibility of conducting a comprehensive research on the subject dissertation. Binding Force of a Contract – Article 171of Law No. 22 of 2004 – Qatar Civil Code â€Å"A contract is the law of the contracting parties, and it may not be revoked or amended, except by agreement of both parties or for prescribed by the law† (Portal, 2014). Dissolution of a Contract Article 183of Law No. 22 of 2004 – Qatar Civil Code Article 183 states that â€Å"In contracts binding on both parties and imposing reciprocal obligations (synallagmatic contracts), where one of the parties fails to perform his obligation, the other party may, upon formal notice to the former, demand performance of the contract or its rescission, and may claim any damages caused by such failure to perform† (Portal, 2014). â€Å"The judge may,mutatis mutandis, determine a period of grace within which the obligor shall perform his obligation. The judge may also reject the application for rescission if the obligation not performed is insignificant compared with the obligations considered in their entirety† (Portal, 2014). Termination of a Contract of Works under Articles 703, 704 707 of Law No. 22 of 2004 – Qatar Civil Code Termination of a Contract under Articles 892 893 of UAE Federal Law No. 2/87 – The Civil Code Dissolution of a Contract under Articles 185 188 of Law No. 22 of 2004 – Qatar Civil Code Article 185 states that â€Å"When a contract is rescinded, the contracting parties shall be reinstated to the position they were in prior to the date of the conclusion of the contract. If reinstatement is impossible, the court may grant indemnity† (Portal, 2014). Article 188 states that; â€Å"The contracting parties may mutually agree to terminate the contract upon its conclusion, provided that the subject matter of the contract remains in the possession of either party. Where the subject matter of the contract is lost, damaged or disposed of in part in favour of a third party, the contract may be rescinded to the extent of the remaining part and the share of the party† (Portal, 2014) Dissolution of a Contract under Article 273 of UAE Federal Law No. 2/87 – The Civil Code Dissolution of a Contract under Articles 267 268 of UAE Federal Law No. 2/87 – The Civil Code The binding force of a Contract under Article 172 of Law No. 22 of 2004 – Qatar Civil Code The effect of the Contract under Article 246 of UAE Federal Law No. 2/87 – The Civil Code Ruling issued for the year 2006 by Court of Cassation, Dubai Literature study and analytical research are my major learning methods which play an important role in this report. Analytical research involves analyzing existing case law, facts and information. The data will be collected from primary/secondary sources, interviews with industry experts and case studies/laws. Literature study and analytical research have been chosen due to complex laws of the country and its interpretation by the Law experts. However, any analysis contained in this dissertation is the author’s own opinion and shall not be construed as evidence in a court of law. This paper does not have any legal or contractual standing in interpreting a binding Contract Document. 5. Scope and Limitation The building construction contracts stipulate express provisions governing the rights of one or both parties to terminate the contract under certain circumstances. These express provisions are categorized as non-contractual rights and contractual rights to terminate a binding contract. The Non-contractual rights to terminate are defined as; Frustration and this occurs when circumstances rather than the default of contracting parties have intervened to prevent the contract being performed as intended originally. When frustration occurs, further performance of the contract is impossible, illegal or radically changed from what the parties contemplated at the time of signing the contract. The contract is automatically terminated once a frustration event occurs and the parties are absolved from further obligations but accrued liabilities remain with them. The party who is relying on frustration provisions in the contract must be sure of that a frustration event actually occurred when justifying the ceasing of operations under the contract to avoid being in breach (the contract is more expensive to perform is not a frustrating event). It is prudent that the events stipulated under force majeure clauses should not overlap with the frustration events and the events which are provided their consequences are stated in the contra cts shall also not be considered as frustrating events. It is imperative to define Force Majeure events in the contract and clause 19.1 of FIDIC 1999 First Edition state that the definition of â€Å"Force Majeure† as; â€Å"Means an exceptional event or circumstance: (a) which is beyond a Party’s control, (b) which such Party could not reasonably have provided against before entering into the Contract, (c) which, having arisen, such Party could not reasonably have avoided or overcome, and (d) which is not substantially attributable to the other Party† (FIDIC, 1999). Force Majeure events are exceptional events or circumstances as listed FIDIC 1999 below and those satisfy the clause 19.1 of FIDIC 1999 sub-clause (a) to (d) above: â€Å"(i) war, hostilities (whether war be declared or not), invasion, act of foreign enemies, (ii) rebellion, terrorism, revolution, insurrection, military or usurped power, or civil war, (iii) riot, commotion, disorder, strike or lockout by persons other than the Contractor’s Personnel and other employees of the Contractor and Subcontractors, (iv) munitions of war, explosive materials, ionising radiation or contamination by radio-activity, except as may be attributable to the Contractor’s use of such munitions, explosives, radiation or radio-activity, and (v) natural catastrophes such as earthquake, hurricane, typhoon or volcanic activity† (FIDIC, 1999). Repudiation and this occurs when a party to the contract commits a serious breach of contract that entitles the innocent party to consider the contract as terminated with immediate effect and sue for damages due to breach of the contract. The following will be considered as clear repudiation of a construction contract Contractor’s refusal to carry out contract scope; Vacant the site or un-authorized removal of plant by the contractor; Procuring other contractors to carry out the whole or part of the scope of work originally contracted; Employer’s failure to give access to the site (possession of the site). The Contractual rights to terminate are classified as; Termination for Cause and the clauses stipulated in the contract vesting powers/rights to terminate the contract for breaches of specified contractual obligations such as unjustified/ unrecoverable delays attributed non-performance of the works. The parties may exercise their rights to terminate in other circumstances too, such as occurrence of a force majeure event. Termination for Convenience or ‘at will’ clauses may be incorporated in to construction contract vesting powers to one party to terminate the contract without having to establish any cause or breach for termination for the other party. This clause is very useful in the event that the; the employer changes the use of the land (eg. Condominium development to a hotel development) the employer’s inability to secure financing for the whole project or secure anchor tenants the contractor finds the project will be unprofitable or too risky the project has been suspended for a prolong period with no prospect of it being recommenced. There is a very close relationship between suspension and termination and, depending on how the clause is drafted. The end result of a suspension clause may be much the same as a termination clause in that either party will have the right to terminate the contract at the end of the agreed suspension period. The justification for suspension clauses will be broadly similar to termination such as a change of circumstances on the ground that makes continuing with the works impossible in the short term. Notwithstanding the above, suspension may be used by one party to allow it space to consider how to proceed with a project, which should be acceptable to the other party if kept within bounds. The scope of this research is to identify the legal provisions to secure the rights and entitlements provided under Qatar Civil Code and UAE Federal Law in Omissions, Suspensions and Terminations and limited to the construction contracts under the jurisdiction of the subject countries. The main limitation is the Language. The Qatar and UAE Laws are written in Arabic and official translation in English language is not available. The author relies on many unofficial translations of Qatar and UAE Laws for the purpose of this research. Arabic language prevails over the any launage in a Court of Law in Qatar and UAE. 6. The Contractors (and the Employers) as the case shall be able to seek the solace of Law even if the Contract Agreement they entered in to is heavily bias towards the Employer as the Law of land prevails over any contractual relationship between parties. 7. The Battle of the Sexes in Susan Glaspells Trifles Essay -- Feminism

The Battle of the Sexes in Susan Glaspell's Trifles 'Well, women are used to worrying over trifles,' (Glaspell 957) remarks crime scene eyewitness Mr. Hale in Susan Glaspell's short play Trifles. As this quotation blatantly demonstrates, literature has had a lengthy history of gender bias, both in terms of adequate representation of women as authors and as formidable, strong characters. In this reference to his and the sheriff's wives, Mr. Hale presents the argumentative conflict that will prove prevalent, if latent, throughout the course of this work. In the play, the male characters are regarded as intellectually superior to their wives, who are patronized as rather childish for their concern in domestic detail. In Trifles, Glaspell makes a feminist leap as she portrays her female characters with ample cunning to secretly and humbly triumph over male condescending. The action of Glaspell's play is executed by a mere five players, three of whom are men - a fact which in itself demonstrates the establishment of women as a minority, even in such a small sampling. The county attorney, Sheriff Peters, Mrs. Peters, eyewitness Mr. Hale, and Mrs. Hale are drawn together in a dismal and atmospheric farmhouse to investigate the murder of Joe Wright, whose wife is the prime suspect. Even in the play's most rudimentary introduction, we are presented with a marked distinction between the men's and women's perspectives. The men immediately perceive the house as a crime scene and as such feel compelled to interview Mr. Hale about details of his visit and officiously search for smoking-gun evidence as to the killer?s motives. Conversely, Mrs. Hale and Mrs. Peters comprehend the environment as something more inti... ...e women remain silent, withholding information from their husbands for the sake of an unhappy mistreated woman whose loneliness and isolation are not terribly far-removed from their own. In her article, Holstein refers to Trifles as a "deceptive play" (Holstein 282), and I believe that to be an excellent choice of description. Trifles only superficially masquerades as a murder mystery; Glaspell has, in actuality, crafted a battle of the sexes - a veritable war between men and women, so imperceptible and silent that not even the characters really know that it exists. Being Careful about Putting Animals in Captivity Essay -- essays resea

Animals in captivity. It has been an issue since the first zoo was opened. Many people are for and against it. I think that there are many pros and cons to having them in captivity. The main issue in the world is how do you possibly make it as close to the animal’s natural environment in captivity. It is almost impossible. You can’t start building sea world all over the ocean and hope the animals show up. I live in Agoura hills, big for horse property. At my grandma’s we have three Arabian horses. The thing is that they are wild animals, and need to do what they do best, RUN. We have three acres of pasture they can run around and play and be horses. Now let me tell you, they love their treats. Animals love to learn. I see it in our horses every day. They are happy. They get kept clean, fed, ridden, and get treats. Wild horses live on hundred of thousands of acres. If you take one of those and train it they love it. They like being fed, cleaned, and get treats. Now a lot of people would say that is different than keeping a killer whale at sea world. In some ways it is and in some ways it isn’t. The whales at sea world are always happy and love attention that they receive. I watched a program on the discovery channel a while a go. It was about the marine animals that were in captivity. Those whales loved being trained and getting a reward of fish when they do something correct. Now look at the con of this situation. Is this anything close to what they would get in nature. No. They do not get the mass oceans to swim. They do not get the freedom to live. But in some ways it is better. The have some of the most amazing trainers, vets, and marine experts in the world on call 24/7. Now I am not saying that we should take ... ...est care and get sick or die (Keiko in Mexico) So you see their a lot of pros and cons. Another point people bring up is the mental stability of the animal. There have been cases that have occurred where the animal snaps and attack the human is usually in captivity. If some idiot goes walking in the Brazilian forests and get attacked by a jaguar that’s his fault. The elephant that attacks humans is usually the humans fault. Either the elephant is cooped up to long and snaps or the trainer did something that made them snap. They are wild and this is the risk. Usually the animals don’t want to hurt the trainers or keepers. This is the risk of having wild animals in shows and captivity. If you can take the risk that is fine but you must make sure all the pros are met and cons kept in mind. They are wonderful creatures and they want to please, but there is a limit. Carolyn Kizer’s Bitch: Closing the Doors on the Past Essay

The poem â€Å"Bitch† by Carolyn Kizer, published in 1984, is one that truly grasps the reader’s attention, beginning with the title itself. The overall tone of this poem intertwines the feelings of sadness and anger and also reveals quite a bit about the speaker’s past. The speaker is referring to her inner self as the â€Å"bitch† and her hurt condition is clearly present throughout the poem. She uses words such as â€Å"bark, growling, slobbers and whimper† to drive this meaning across to the reader. It is in the speaker’s own representation of her inner self as a â€Å"bitch,† one that not only bark[s] hysterically,† but also may â€Å"whimper,† and even â€Å"cringe†. The speaker is easily inclined to remember past memories from the relationship and struggles with revealing her inner emotions and putting on a calm outward appearance. This is an experience which is quite familiar to me, as a reader. I am often faced with the choice of being a â€Å"bitch† to someone (ex-boyfriend, annoying relative, a backstabbing friend†¦ etc) and showing how I truly feel or being a controlled and relaxed young woman. Kizer uses the imagery of a dog throughout the poem to show the speaker’s different emotions. Bitch† begins by describing an encounter between the speaker and an ex-lover. Lines 1 and 2 (â€Å"Now, when he and I meet†¦ growling†) reveal that these two have not kept in contact over the years. Although the speaker feels hurt and angry about the past, she tells herself to control her emotions. She is fghting with herself to not let her true feelings show. Should she scream out in anger or break down in tears to express her hurt state? Or should she stay quiet and maintain her calm nature? There is obviously tension present in these first few lines. At this point in the poem, the reader does not know ow or why this relationship ended, but the break-up clearly hurt the â€Å"bitch† more than it hurt her lover. The speaker displays an outward appearance of kindness and self-control, while she is really growing more and more furious inside (lines 5 and 6). My voice says, â€Å"Nice to see you, as the bitch starts to bark hysterically’). In line 7 (â€Å"He isn’t an enemy now’) the speaker is telling herself that she should not be dwelling on the past because her ex cant hurt her anymore. The â€Å"bitch† seems to be doing fine in controlling her emotions until line 9 when her ex-lover asks her: *dow are the children? They must be growing up. An immediate change of tone occurs here. There is an internal struggle going on between her heart and her mind. The speaker’s mind is telling her to be polite to her ex, forget the past and move on. The bitch’s heart, on the other hand, is keeping her from moving on and causing her to struggle with feelings of desire. This is clear, for example, in lines 10-13: â€Å"Ata kind word from him†¦ Down, girl! Keep your distance. † The speaker knows that if she up getting hurt. Kind words and gestures can often be deceiving and I have learned that unfortunately charming people are dangerous. I have been hurt numerous times y such personalities by only looking at their kind side and ignoring other flaws. The bitch is warning herself to not get caught up in this trap of feelings again. Quite a bit of information about the past is exposed in (lines 17-21): † She is basically loyal†¦ Until he was ready to play. This means that the speaker was always loyal and kind to her lover, but he was bored with her and still thought that she was not good enough. The imagery here is being compared to the relationship between an owner and his loving and loyal dog. Some words that emphasize this relationship are â€Å"running†, â€Å"lay at his feet†, and â€Å"ready to play’. A bitch is always ready to do what one wants and it is clear that this was the sor t of relationship that the speaker and her lover had. If he wanted her to wait for something, she was willing to wait. If he needed something, she would get it for him. If she was given an order, she would immediately act upon it. The image of an obedient dog comes to mind while reading these ending stanzas. Although the speaker is struggling with feelings of anger and repression, she still desires reconciliation. Her emotions are running wild with memories of her past, but she knows she can’t express them. She wants to be the bigger person in this uncomfortable situation because she knows she will end up getting hurt again if she â€Å"barks† or â€Å"whimpers†. In the final lines of the poem, from lines 28 to 34, the speaker reveals her final thoughts and emotions of the past and, especially, for this man, whom she cared for. The speaker seems to have given up her tender feelings for him. As she reveals these aspects, she also gives the readers and the â€Å"bitch,† or at least the woman that she was, some information on this man she has been speaking to. The readers learn that the unidentified man has perhaps remarried? (Line 31) Since he bitch sees that he has moved on with his life, she knows that it is only right that she does as well.

In this assignment, I will be exploring the marketing mix and all of its different factors as well as to apply this to Coca-Cola and how they are currently and may be affected by the marketing mix in the future. Product – A product is anything that is capable of satisfying customer needs. There are two different offerings of this being, a physical item or of a virtual type. The product is therefore created at a specific cost and marketed at a desired price that would be deemed as acceptable for the quality of the item. Every product will follow a lifecycle, a company can increase its competitive edge. There are many different ways in which they can develop or expand upon a certain product so that it can remain relevant and up to date with the changing market especially when it reaches the decline or end of its life. Product development – The process of creating or improving a product or service and managing it during all stages from design through marketing. Product development is a key part of introducing a new, appealing product to their audience, this process may involve numerous modifications to the product so that it does meet the needs and purpose of the product. There are various stages that a new or improved product or service goes through from design, through developing, testing, and marketing it. Form and Function – form fit function, is used in manufacturing to describe the identifying characteristics of a part. For example, the screw is intended to hold other parts of the product together. In practice, the rule of form follows function, start the design process by first getting as much information as possible about the purpose of the piece you are creating. Using this process allows a company to understand and ensure that the product is acceptable as well as fit for its purpose. Without this process, the intentions and purpose for a product can be lost, which ideally is not a stage of which what a company would want to beat. Packaging – Packaging is a very crucial part when creating and marketing a product because it is the first thing the customer sees before purchasing the product, therefore, this makes the packaging of the product to be respectable and appropriate to catch the eye of the consumer. How the product is packaged may also be what attracts the consumer to check out the product on the shelf or it could be a product that stands out from the rest online, amongst its competitors. For this reason, companies conduct extensive research on color schemes, designs and types of product packaging that is the most appealing to its intended consumer. The main function of packaging is to protect the product from damage during the process from the producer to the consumer, this process involves travel and shelf life of the product. Branding – Branding a product was much easier when there were no websites, smartphones, interactive games or social media. Today, creative teams are required to seamlessly brand products across multiple media, using the same voice, design and messaging, often with different creative teams and designers creating separate brand extensions. Without a strong brand behind your product line, there’s little to compel a buyer to choose you over another option. And with so many options in most markets today, branding is more important than ever. Product branding gives the items in your store an identity within the marketplace. Good branding can allow your specific products to stand out against what a competitor offers, and engender the kind of brand loyalty that pulls customers into your store.
